Partner Geoffrey Robb Obtains Defense Verdict in a Personal Injury Sportfishing Case: Campbell v. Logue, USDC for the Southern District of California (10cv1821 JM)
In June 2013, following a six day bench trial, Geoffrey Robb obtained a defense verdict where the plaintiff sought $9 million in damages for injuries when he fell on the bow of a luxury sport fishing vessel near Cabo San Lucas. Plaintiff sustained significant injuries, including a broken pelvis, followed by complications in the hospital, including a subdural hematoma and wound infection, culminating in three head surgeries. The federal court declined to apply California law on the assumption of risk on defendants motion for summary judgment but found for the defendant vessel owner and captain defendants at trial on plaintiff’s claims of negligent operation.
